Terms and conditions
1. Object
1.1. These Terms and Conditions regulate the adhesion, access and
use of MedPortal - Medical and Patient Portal.
1.2. Access to and use of MedPortal is governed by these Terms and
Conditions.
1.3. These Terms and Conditions are complemented and integrated,
in everything that is not provided for in this document, by the Privacy Policy
of this portal.
1.4. In case of contradiction, inconsistency or non-compliance
between these Terms and Conditions and the Privacy Policy, the rules and
conditions defined herein prevail.
2. Description of MedPortal - Doctor and Patient
Portal
2.1. MedPortal provides its users with a reserved area, in which
they can access a range of information, including scheduling appointments and
complementary means of diagnosis and therapy, consulting results (reports and
images) of complementary means of diagnosis and therapy including clinical
analysis and consulting Useful information.
2.2. Access to MedPortal presupposes adherence to MedPortal Terms
and Conditions and other formalities described in number 3.
3. Form of Adhesion
3.1. Individuals who meet the following requirements can join
MedPortal - Doctor and Patient Portal:
(a) Are over 16 years of age, with full legal capacity;
(b) Are clients of the Medical Institution;
(c) Accept these Terms and Conditions.
3.2. Adhesion to MedPortal must be made through the portal's
website, in which the user must register, by including the access data provided
by the Medical Institution.
3.3. MedPortal provides information regarding the Medical
Institution.
4. Access to MedPortal - Doctor and Patient
Portal
4.1. Access to MedPortal presupposes that the user fills in their
access data (and may, at any time, change their password).
4.2. In case of forgetting the access data, the user can request
the issuance of new data through the link available in the access area of
MedPortal. The process of assigning new data is done by email, according to
the address provided in the first access (accession).
4.3. The user must keep the MedPortal access data confidential,
and in particular must not disclose them to third parties or browse in
conditions that allow their decoding and copying by unauthorized third parties.
5. Personal Data
5.1. Personal data made available within the scope of MedPortal
will be processed by the Medical Institution, for the purposes of managing the
portal, including for the services made available there, such as the request
for appointment scheduling and complementary diagnostic and therapeutic means,
the consultation of results complementary means of diagnosis and therapy, among
others, without prejudice to the processing of data for the purposes described
in the Privacy Policy.
5.2. The user may, at any time, request access, rectification and
deletion of their personal data, by contacting the Medical Institution where
they registered and presenting their identification document.
6. Security
6.1. Any acts or attempts to change materials, content or
software, upload information, unauthorized access or any other action that may
cause damage or put at risk the integrity, continuity or quality of MedPortal,
namely:
(i) Violation of authentication or security systems that protect
access accounts, servers, services or networks;
(ii) Unauthorized access or collection of any other data, personal
or not, any type of Phishing practice being prohibited;
(iii) Unauthorized search for vulnerabilities or deficiencies in
access accounts, servers, services, networks, in particular the systematic
detection of response to services (Scan);
(iv) Entry into computer systems, services or networks without the
express authorization of those responsible or holders (Break In);
(v) Illegal or improper interception and/or interference (and
attempted) with any data, systems or equipment not being authorized to do so.
6.2. The user is responsible for ensuring the security of the
equipment used to access MedPortal.
7. Responsibility
7.1. In case of loss, theft or loss of access data to MedPortal,
the user must immediately notify the Medical Institution, requesting the
issuance of new access data to MedPortal.
7.2. The user is responsible for the access that third parties
make to MedPortal, in the case described in the previous number.
8. Suspension of MedPortal
8.1. The Medical Institution shall have the right, at any time and
without prior notice, to take the necessary measures, including access
restrictions or limitations, to ensure the integrity, security, continuity or
quality of MedPortal – Doctor and Patient Portal.
8.2. The Medical Institution will not be responsible for errors
that may occur due to system irregularities, failure (temporary or permanent)
of MedPortal, applications or other tools. The Medical Institution will not be
liable for any damages resulting from improper use or impossibility of using
MedPortal.
9. Changes
The Medical Institution has the exclusive right, at any time and
without prior notice, to update, change or suspend, partially or totally, the
features available on MedPortal, in particular those referred to in number 2.,
which may be implemented in a manner phased and not available at the time of
the portal's launch.
10. Term
These Terms and Conditions come into effect on the date the user
joins and remain in force for an indefinite period.
11. Final provisions
11.1. If any of the provisions of these Terms and Conditions are
found to be null or otherwise invalid, or if the enforceability of any
provision of these Terms and Conditions is in any way limited by a court or
other competent entity, such nullity, invalidity or unenforceability will not
affect the validity and enforceability of the remaining provisions.
11.2. The lack of demand by the Medical Institution, at any given
time, for the user to comply with any of their contractual obligations, does
not imply a waiver of any rights, nor does it constitute a right acquired by
the user.
12. Applicable law and jurisdiction
12.1. The Terms and Conditions will be governed by, and
interpreted in accordance with, the law of the country in which the Medical
Institution provides its services.
12.2. Without prejudice to the applicable mandatory legal
provisions, the local courts will be exclusively competent.

Privacy Policy
The Medical Institution
guarantees MedPortal users respect for their privacy.
Visiting this website,
by itself, does not automatically register any personal data that identifies
the user. However, the use of certain contents or services may imply the
provision by users of personal data.
This Privacy Policy is
an integral part of the MedPortal - Doctor and Patient Portal Terms and
Conditions and regulates the collection and processing of personal data
provided by users, as well as the exercise of their rights in relation to this
data, under the terms of the Law of Personal Data Protection in force.
Data Collection and Processing
The Medical Institution
is the entity responsible for collecting and processing users' personal data.
The personal data
collected will be processed and stored by computer by the Medical Institution
or by entities subcontracted by it and are intended to respond to your requests
for appointments, as well as your comments, requests for clarification and
suggestions.
The personal data
collected will be kept in such a way as to allow their identification only for
the period necessary for the pursuit of the purposes of collection or further
processing, after which they will be deleted.
The Medical Institution
assumes that the collected data were inserted by the respective holder and that
their insertion was authorized by the same, being the same true and exact.
Right of Access
Pursuant to the law,
the user is guaranteed the right to access, update and rectify their personal
data, as well as the right to object to their processing, upon written request
addressed to the Medical Institution's Customer Service.
Data communication
The Medical Institution
may communicate your personal data to third parties provided that for this
purpose it has unequivocally obtained the consent of users or when:
- the communication
takes place within the scope of compliance with a legal obligation, a decision
of the National Data Protection Commission or a court order;
- the communication is
carried out to protect the vital interests of users or any other legitimate
purpose provided for by law.

The Medical Institution
makes its best efforts to protect users' personal data against unauthorized
access via the Internet. To this end, as well as to prevent unauthorized access
to data, misuse, disclosure, loss or destruction, it uses security systems,
rules and other procedures.
It is, however, your
responsibility to guarantee and ensure that the device from which you are
accessing MedPortal is adequately protected against harmful software, computer
viruses and worms. Additionally, you should be aware that, without the adoption
of adequate security measures (namely the safe configuration of the browser,
updated antivirus software, security barrier software and the non-use of
software of dubious origin), the risk of personal data and passwords being
accessed by third parties, without authorization to do so, is aggravated.

ensure a proper user experience. The information obtained has no other use. A
cookie is information that is automatically placed on the hard drives of users'
computers when they access some websites. MedPortal uses cookies only during a
session, namely to save the language, the unit, the type of access device and

is carried out in accordance with standard security procedures and practices

reserves the right, at any time and without prior notice and with immediate
effect, to change, add or revoke, partially or totally, this Privacy Policy.
